1. Acceptance of Terms

By accessing DalalAI ("the Platform"), available at dalalai.com, you agree to be bound by these Terms of Service. If you do not agree to these terms, please discontinue use immediately.

2. Nature of Service

3. No Investment Advice

All information, signals, forecasts, scores (DVM, TechnoFunda, AI models), and recommendations on this Platform are for educational and informational purposes only. They do not constitute:

• Investment advice or financial advice
• Trading advice or recommendations to buy/sell securities
• Tax, legal, or accounting advice
• A solicitation to buy or sell any security

You should not treat any of the Platform's content as such. Always consult a SEBI-registered investment advisor before making investment decisions.

4. Risk Acknowledgement

By using the Platform, you acknowledge that:

• Stock market investments are subject to market risks
• Past performance is not indicative of future results
• AI-generated forecasts may be inaccurate, delayed, or incomplete
• Backtested results are hypothetical and do not guarantee future performance
• You are solely responsible for your own investment decisions
• You may lose some or all of your invested capital

5. User Accounts

• You must sign in with a valid Google account to access the Platform
• You are responsible for maintaining the security of your account
• You agree not to share access credentials or misuse the Platform
• One account per person — multiple accounts may be terminated
• We reserve the right to suspend or terminate accounts that violate these terms

6. Subscription & Payments

• The Platform offers free (Basic) and paid tiers (Premium, Platinum, Developer)
• Premium and Platinum are available as day-passes (₹49/day, ₹99/day) and monthly plans
• The Developer tier (₹1,999/month) provides programmatic API access — see Section 16 for additional terms
• Payments are processed by PhonePe — we never access your payment credentials
• Day-passes expire automatically at the end of the purchased period
• Strict No-Refund Policy: All purchases are final. Once a subscription or day-pass is purchased, it is non-refundable under any circumstances, including but not limited to: dissatisfaction with the service, inability to use the service, technical issues, accidental purchases, or change of mind. By completing a payment, you acknowledge and accept this no-refund policy.

7. Free Tier & Trial

Basic (free) users receive access to a core set of features. New users are offered a 3-day free trial to experience Premium or Platinum features. After the trial ends, users revert to the Basic tier unless they upgrade. Trial availability and terms are provided at our discretion and may be modified or discontinued at any time.

8. Intellectual Property

All content, algorithms, scoring models (DVM, TechnoFunda), UI designs, code, and data visualizations on the Platform are the intellectual property of DalalAI. You may not:

• Copy, reproduce, or redistribute Platform content
• Reverse-engineer the scoring algorithms or AI models
• Scrape, crawl, or programmatically access the Platform except through the authorized Developer API with a valid API key (see Section 16)
• Use the Platform's output for commercial purposes without permission

9. Acceptable Use

You agree not to:

• Use the Platform for any unlawful purpose
• Attempt to gain unauthorized access to Platform systems
• Interfere with the Platform's operation or other users' access
• Upload malicious code or exploit vulnerabilities
• Misrepresent the Platform's outputs as SEBI-registered advice

10. Limitation of Liability

To the maximum extent permitted by law:

• DalalAI shall not be held liable for any direct, indirect, incidental, or consequential losses arising from the use of this Platform
• This includes (but is not limited to) financial losses from trading based on Platform signals
• The Platform is provided "as is" without warranties of any kind
• We do not guarantee uptime, accuracy, or completeness of data

11. Indemnification

You agree to indemnify and hold harmless DalalAI, its creator, and affiliates from any claims, damages, or expenses arising from your use of the Platform or violation of these terms.

12. Modifications

We reserve the right to modify these Terms of Service at any time. Changes will be posted on this page with an updated date. Continued use of the Platform after changes constitutes acceptance of the updated terms.

13. Termination

We may terminate or suspend your access to the Platform at our sole discretion, without prior notice, for conduct that we believe violates these terms or is harmful to other users or the Platform.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka, India.

16. Developer API Terms

The following additional terms apply to users of the DalalAI Developer API:

16.1 API Key Security

• Your API key is a secret credential — treat it like a password
• Do not expose your key in client-side code, public repositories, or shared documents
• You are responsible for all activity under your API key
• If you suspect your key has been compromised, regenerate it immediately from the Developer Dashboard
• We reserve the right to revoke keys that are misused or compromised

16.2 Rate Limits & Quotas

• Trial keys: 25 total lifetime calls, 5 requests/minute
• Free tier: 10 requests/day, 5 requests/minute
• Starter keys: 5,000 requests/day, 100 requests/minute
• Pro keys: 50,000 requests/day, 500 requests/minute
• Enterprise keys: 1,00,000 requests/day, 1,000 requests/minute
• Exceeding limits results in 429 Too Many Requests responses
• Automated retry logic must respect Retry-After headers
• Deliberate abuse of rate limits may result in key revocation

16.3 Acceptable API Use

You may use the API to:

• Build applications, dashboards, or tools for personal or commercial use
• Integrate DalalAI data into your own products for end users
• Perform research and analysis using the data

You may not:

• Resell, redistribute, or sublicense raw API data as a standalone data product
• Use the API to build a competing stock analytics platform
• Share your API key with third parties
• Use automated systems to circumvent rate limits
• Store and serve cached data beyond 24 hours without refreshing from the API

16.4 Data Usage & Attribution

• API responses are licensed for use within your applications only
• You must include the attribution "Data powered by DalalAI" in any public-facing use
• The data is provided "as-is" — see Section 10 for liability limitations
• Data accuracy, update frequency, and availability are not guaranteed

16.5 Service Availability

• We target 99.5% uptime but do not offer a formal SLA
• Scheduled maintenance windows will be announced on the API Status page
• We may throttle or suspend API access during high-load periods
• API endpoints, response formats, and features may change — we will provide reasonable notice for breaking changes

16.6 Termination of API Access

• API access terminates when your Developer subscription expires
• We may revoke API access immediately for Terms violations
• Upon termination, you must delete all cached API data within 30 days
